What needs to be done:

  • perform on a permanent basis based on the monitoring of business relations/financial transactions of clients of all types (individuals, legal entities, sole proprietorships), with timely detection of dubious, suspicious financial transactions/activities of the client (which are not typical for clients similar in size/type of activity/amount of income/social status, etc.), transactions that carry an increased risk of conducting illegal transactions, with the adoption of reasoned decisions based on the result of its conduct;
  • perform on an ongoing basis a comprehensive analysis of customers engaged in the purchase of military and defense goods (taking into account procurement through the public or defense procurement procedure) at the expense of state budget funds obtained as a result of concluding contracts with state bodies, in particular, the Ministry of Defense of Ukraine, the State Service of Special Communications and Information Protection of Ukraine and with others, in terms of identifying all inherent risk criteria, including shell company criteria, proper risk assessment; detection of indicators of suspiciousness of financial transactions;
  • take appropriate measures to confirm/refute suspicions regarding financial transactions/activities of clients (including regarding clients defined under clause 2), ensuring further monitoring of financial transactions operations, in particular, in case of receiving/discovering negative information;
  • when performing an analysis of clients/financial transactions of clients defined by p. 2, perform work with documents containing state secrets, in compliance with the procedure established by law, with the implementation of an in-depth analysis of the specified contracts before the implementation of theaccounts under them and/or during the enrollment, transfer or refund of funds under this contract; style="font-style: normal; font-weight: 400">ensure a thorough and comprehensive analysis of the clients specified in clause 2 and their contracts containing state secrets, regarding participants in financial transactions; documents, which are the basis for carrying out financial transactions, with the comparison of the terms of the contracts concluded between the client and the state body, with the terms of the contracts concluded between the client and its counterparties, in which the goods are purchased (ratio of the price of the goods, the impossibility of carrying out settlements under contracts with a significant overestimation of the value of the goods; the subject of the purchase; the term of delivery of the goods; terms of settlement, etc.); monitoring of the client's targeted use of funds received from state authorities for the purchase of military and defense goods, taking into account during the analysis of negative information received from state/law enforcement agencies available in open sources, etc.
    5. Make independent decision-making based on the results of the analysis of the clients specified in clause 2 and their contracts containing state secrets, including regarding the justified assessment of risks and the possibility of carrying out settlements according to the specified contracts/establishing signs of suspicious financial transactions and/or client activity, with the provision of notification to the FSMU, in accordance with the established procedure for information exchange;
  • document the measures taken in order to fulfill the requirements of the AML/CFT legislation, including due diligence of clients, in particular, clients who carry out activities related to state secrets.

This will require:

The presence of work experience in the banking system in the financial monitoring unit, during the period of validity of the current Law No. 361-IX from 06.12.2019, but not less than 1 calendar year, with corresponding practical application of the requirements defined by them:

  • the presence of analytical abilities, the ability to process a significant amount of information, the presence of a sufficient/high level of expertise in conducting complex analysis customers/customer activities;
  • ability to clearly understand certainsituation and identifying cause-and-effect relationships;
  • ability to work with the legislative and regulatory framework, the ability to process economic, legal, tax, criminal and other documents/information of various complexity, with subsequent independent drawing up of the necessary conclusion on the researched question and its application in the implementation of complex analytical work;
  • ability to understand and practically apply the current requirements of the NBU and other authorized bodies regarding the risk criteria of clients and their activities; the ability to develop measures (proposals) for the management of identified risks;
  • the presence of a high level of self-organization, efficiency, attention to details, with a simultaneous understanding of the general content and purpose of the issue being studied;
  • the presence of high moral qualities, non-conflict, decency, responsibility, the ability to work in a team to achieve a common goal and maintain a friendly atmosphere in the team, the appropriate educational, qualification and professional level responsibilities.
